CLERK'S SUMMONS IN EQUITABLE PROCEEDINGS
STATE OF ARKANSAS
To the Sheriff of Pope County:
You are commanded to summon George W. Baucum, to answer in
twenty days after the service of this summons upon him a complaint in equity filed against him in the
Pope Circuit Court by Mary E. Baucum, and
warn him that upon his failure to answer, the complaint will be taken for confessed; and you will make
due return of this summons on the first day of the next April term of said court.

George W Bawcum | Defendant

Now on this day this cause came on to be upon
bill and depositions filed in this cause, and
it appearing from the said bill and depositions
there was no collusion between the said parties
for the purpose of being divorced and that said
defendant had absented himself from said
plaintiff more than one year before the filing of
Plaintiff's Bill, without cause or provocation
it is therefore ordered adjudged and decreed
by the Court that the bond of matrimony heretofor
subsisting between plaintiff and defendant
be dissolved.

Ordered that the Court adjourn until Court in Co-s-

The deposition of D T Webb and Sary P
Webb at the Residence of D T Webb
(to be read) taken on the 15th day of March
1870 to be read as evidence in an action
between Elizabeth Bawcum Plaintiff
and George Bawcum Defendant
pending in the Pope Circuit Court.


David T Webb a witness for the Plaintiff af-
-ter being duly sworn testifies as follows. I
am acquainted with the parties to this suit.
The plaintiff was married to the defendant
on the 28th day of May AD 1868 from the
time of the marriage the Plaintiff lived
and cohabitted with the Defendant and
faithfully performed her duties as a wife
until she was abandoned by him on
the 1st day of January AD 1869. The Defen-
-dant deserted the Plaintiff and has
continued from that time until now
to absent himself from her bed and
board without any reasonable cause
or provocation while they lived together. I
was frequently at their House and they
was (sic) frequently at my House.

and they always appeared to live toget-
-her happily and agreeable till he
abandoned her without any known
cause as above stated and further
this deponant says not

Sary P Webb a withness for the Plaintiff
after being duly sworn testifies as foll-
-ows. I am acquainted with the parties
to this suit the Plaintiff was married
to the defendant on the 28 day of May
AD 1868 from the tiem of the marriage
the Plaintiff lived and cohabitted with
the defendant and faithfully performed
her duties as a wife until she was
abandoned by him on the 1st day of
January AD 1869 the Defendant des-
-erted the Plaintiff and has continued
from that time until now to absent
himself from her bed and board with
-out any reasonable cause or provocation
While they lived together I was frequently
at there (sic) House and they were frequen-
-tly at my House and they always
appeared to live together happily and
agreeable til he abandoned her without
any known cause as above stated and
further the deponant says not

evidence they should give in the action
should be the truth the whole truth and
nothing but the truth and their statements
reduced to writing by me in their presence
the? Plaintiff also/alone? being present by
attorney at the examination.

  Mary E Baucum the plaintiff stated?
that she has resided in the State of Ark
ansas for more than one year next?
before the commencement of this action
and is at present a bona fide resident
of Pope County in said State, that she
was lawfully married to George W Baucum
on the 28th day of May 1868 and for
a short time she lived happily with the
said George W Baucum in said Pope
County where they were married.
Plaintiff states that she at all times
conducted herself towards said George
W Baucum as a faithful and
loving wife and was always atten-
tive to his reasonable wants, and
labored faithfully to contribute to
his comfort and happiness, yet she
states that the said George W Baucum
appeared to become disatisfied soon
after their said marriage and left
her bed and board without any
reasonable cause and has been
absent from her for more than
twelve months before the comm
encement of this action, and
has -hally neglected to provide for
the comfort and wants of her

the said plaintiff and still
neglects and refuses so to do, Plaintiff
therefore prays that said George W Bau
cum be made a defendant to
this action, and that he be sum-
moned and answer?, and that upon
the hearing of this cause a decree
be made divorcing her from the said
George W Baucum, and dissolving the
bond of matrimony heretofore subsisting
between them, and that the Plaintiff
be returned to the name of Mary E Hooper
the name she bore previous to said
marriage, and for such other and?
further relief as the nature of the
case may require
